Terms of Service

Welcome to Blobert!

These Terms of Service ("Terms") govern your use of the Blobert mobile application ("Blobert - Cook More!" or the "App"), operated by Blobert ("we," "our," or "us"). By downloading, accessing, or using the App, you agree to be bound by these Terms.

Please read these Terms carefully before using the App. If you do not agree to these Terms, you must not use the App.

1. Description of Service

Blobert is an AI-powered cooking companion that generates personalized recipes based on your available ingredients, dietary preferences, allergies, skill level, and kitchen equipment. The App uses artificial intelligence technology to create recipe suggestions tailored to your profile.

2. Eligibility

You must be at least 13 years of age to use Blobert. By using the App, you represent and warrant that you meet this age requirement. If you are under 18, you should review these Terms with a parent or guardian to ensure they understand and agree to these Terms.

3. Account Registration

To use certain features of the App, you may need to create an account. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Promptly update your information if it changes
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent or abusive behavior.

4. Subscription and Payments

Pro Subscription

Blobert offers a Pro subscription that provides access to premium features. The Pro subscription includes a 3-day free trial period.

Trial Period

  • New subscribers receive a 3-day free trial before being charged
  • If you cancel your subscription during the trial period, you will not be charged
  • If you do not cancel before the trial period ends, your payment method will be charged automatically

Billing and Renewal

  • Subscriptions are billed through the Apple App Store or Google Play Store
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
  • You can manage and cancel your subscription through your device's app store settings

Refund Policy

⚠️ No Refunds: After the 3-day trial period ends and your payment method is charged, all subscription payments are final and non-refundable. We encourage you to fully evaluate the App during the trial period. For any billing disputes, please contact your app store directly.

5. AI-Generated Content Disclaimer

⚠️ Important Notice About AI-Generated Recipes:

Blobert uses artificial intelligence to generate recipe suggestions. While we strive to provide helpful and accurate recipes, you acknowledge and agree that:

  • AI Can Make Mistakes: AI-generated content may contain errors, inaccuracies, or omissions
  • Always Verify Ingredients: You must always check and verify all ingredients before cooking, especially if you have food allergies, intolerances, or dietary restrictions
  • Not Medical Advice: Recipe suggestions are not medical or nutritional advice
  • Your Responsibility: You are solely responsible for ensuring that any recipe you prepare is safe and suitable for you and anyone you serve

6. Food Allergies and Dietary Restrictions

🍳 Critical Health Information:

While Blobert is designed to consider your stated food allergies and dietary restrictions when generating recipes, you must understand that:

  • AI Limitations: No AI system is infallible. Blobert may occasionally suggest recipes containing ingredients you should avoid, or fail to identify all allergens in a recipe
  • Cross-Contamination: Blobert cannot account for cross-contamination risks in food preparation or manufacturing
  • Hidden Ingredients: Some ingredients may contain hidden allergens not obvious from their names
  • Always Double-Check: You must carefully review all ingredients in every recipe before preparing or consuming any food
  • Consult Professionals: If you have severe allergies or medical conditions, consult with healthcare professionals before preparing unfamiliar recipes

Blobert is not a substitute for careful food allergy management. Your safety is your responsibility.

7. Acceptable Use

You agree not to:

  • Use the App for any unlawful purpose
  • Attempt to gain unauthorized access to the App or its systems
  • Interfere with or disrupt the App's functionality
  • Reverse engineer, decompile, or disassemble any part of the App
  • Use automated tools to access the App without permission
  • Share your account credentials with others
  • Misrepresent your identity or affiliation

8. Intellectual Property

The App, including its design, features, graphics, and content (excluding user-provided information), is owned by Blobert and protected by intellectual property laws. You may not:

  • Copy, modify, or distribute the App's content without permission
  • Use the Blobert name, logo, or branding without authorization
  • Create derivative works based on the App

You retain ownership of any personal information and content you provide to the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The App will be uninterrupted, secure, or error-free
  • Any recipes or suggestions will be accurate, complete, or suitable for your needs
  • The App will meet your specific requirements
  • Any errors in the App will be corrected

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLOBERT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

  • Personal injury or health issues resulting from recipes or food prepared using Blobert
  • Allergic reactions or adverse health effects from consuming food prepared based on Blobert's suggestions
  • Loss of data or unauthorized access to your information
  • Any other damages arising from your use of the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID FOR THE APP OR SUBSCRIPTION IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Indemnification

You agree to indemnify, defend, and hold harmless Blobert and its affiliates from any claims, liabilities, damages, losses, and expenses (including attorneys' fees) arising from your use of the App, violation of these Terms, or infringement of any third-party rights.

12. Modifications to the App and Terms

We reserve the right to modify, suspend, or discontinue the App at any time without notice. We may also update these Terms from time to time. Continued use of the App after changes to the Terms constitutes acceptance of the updated Terms.

13. Termination

We may terminate or suspend your access to the App immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
